Agreement to Terms
These Terms of Service constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Bitfuturistic Solutions LLC, doing business as ClarityCall ("ClarityCall," "we," "us," or "our"), concerning your access to and use of the ClarityCall website (https://claritycall.app) and our AI-powered meeting transcription and personality analysis services (collectively, the "Services").
By accessing or using the Services, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Service. It is your responsibility to periodically review these Terms to stay informed of updates.
By continuing to use the Services after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
The Services are intended for users who are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Services.
1. Services Description
ClarityCall provides AI-powered meeting transcription and personality analysis services, including:
- Audio and video recording upload
- Automated transcription with speaker identification (diarization)
- Personality profiling and analysis
- Contact management with evolving personality insights
- Communication recommendations and actionable guidance
The Services use third-party AI providers including transcription services and AI processing services to deliver these features.
The Services are provided on a software-as-a-service (SaaS) basis. You access the Services remotely via the cloud; you do not receive a copy of the software to install locally.
2. Eligibility and Account Registration
Eligibility
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement.
Account registration
To access the Services, you must register for an account by providing:
- A valid email address
- A secure password
- Accurate account information
You agree to:
- Provide true, accurate, current, and complete information during registration
- Maintain and promptly update your registration information to keep it accurate
- Keep your password confidential and secure
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access to your account
We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that it is inappropriate, obscene, or otherwise objectionable.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.
3. Fees and Payment
ClarityCall offers both free and paid subscription plans. Specific pricing and plan details are available on our website at https://claritycall.app/pricing.
Subscription fees
- All fees are stated in U.S. Dollars (USD)
- Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select
- Payment is due immediately upon subscription or renewal
- All fees are non-refundable except as expressly stated in these Terms or required by law
Payment methods
We accept major credit cards and other payment methods as indicated during checkout. Payment processing is handled securely by our third-party payment provider. We do not store your full credit card information.
You authorize us to charge your selected payment method for all fees owed for your subscription.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee for your plan upon renewal.
7-Day money-back guarantee
We offer a 7-day money-back guarantee on your initial subscription purchase. If you are not satisfied with ClarityCall for any reason within the first 7 days of your subscription, you may request a full refund of your initial payment.
To request a refund, contact us at support@claritycall.app within 7 days of your initial purchase. Refunds will be processed within 5-7 business days and issued to your original payment method.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at support@claritycall.app. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that time.

Price changes
We may change our subscription fees at any time. We will provide you with reasonable advance notice of any fee changes. Your continued use of the Services after a price change takes effect constitutes your agreement to pay the modified fee.
4. Use Restrictions and Prohibited Activities
Permitted use
You may use the Services only for lawful purposes and in accordance with these Terms. You may use the Services for your own business or personal use to:
- Upload and transcribe meeting recordings
- Analyze communication patterns and personalities
- Manage contacts and communication insights
Prohibited activities
You agree not to:
- Violate laws: Use the Services for any illegal purpose or in violation of any local, state, national, or international law.
- Infringe rights: Violate the intellectual property rights, privacy rights, or other rights of any third party.
- Unauthorized access: Attempt to gain unauthorized access to any portion of the Services, other users' accounts, or any systems or networks connected to the Services.
- Reverse engineering: Decompile, disassemble, reverse engineer, or otherwise attempt to discover the source code or underlying algorithms of the Services.
- Scraping and automation: Use any robot, spider, scraper, or other automated means to access the Services or collect data from the Services without our express written permission.
- Interfere with services: Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of such networks.
- Misrepresent identity: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
- Distribute malware: Upload, transmit, or distribute any viruses, malware, or other malicious code that could damage or interfere with the Services.
- Bulk operations: Use the Services to send spam, chain letters, or other unsolicited mass communications.
- Resell services: Resell, sublicense, or redistribute the Services or any insights generated by the Services for commercial purposes beyond your own business use.
- Share accounts: Share your account credentials with others or allow others to access your account.
- Abuse resources: Use the Services in a manner that places an unreasonable burden on our infrastructure or systems.
- Violate third-party terms: Upload content that violates the terms of service of third-party platforms or services.
Enforcement
We reserve the right to investigate violations of these Terms and to take appropriate action, including but not limited to removing content, suspending or terminating accounts, and reporting illegal activity to law enforcement.
5. Audio Consent and Recording Responsibilities
Important legal notice about audio recordings
By submitting or uploading audio or video recordings through ClarityCall, you consent to the analysis, transcription, and temporary storage of your voice data for the purpose of generating communication insights and personality profiles. Audio data may be processed by trusted third-party providers under data protection agreements.
Your responsibilities
You represent and warrant that:
- You have the legal right to upload and share all recordings you submit to the Services
- You have obtained all necessary consents from participants in recordings where required by applicable law
- Your recordings do not violate any laws, regulations, or third-party rights
- You will comply with all applicable recording consent laws in your jurisdiction
Recording consent laws
Many jurisdictions require consent from all parties before recording conversations:
- One-party consent states: At least one participant (which may be you) must consent to the recording
- All-party consent states: All participants must consent to the recording
It is your sole responsibility to:
- Understand and comply with the recording laws applicable to you
- Obtain necessary consents before recording any conversation
- Inform participants that recordings may be processed by AI services for transcription and analysis
We are not responsible for your failure to obtain required consents or comply with applicable recording laws. You agree to indemnify and hold us harmless from any claims arising from your recordings.
6. Intellectual Property Rights
Our intellectual property
The Services, including all software, designs, text, graphics, logos, interfaces, databases, and functionality, are owned by Bitfuturistic Solutions LLC and are protected by copyright, trademark, and other intellectual property laws.
These Terms do not grant you any ownership rights to the Services. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms.
Your content
You retain all ownership rights to:
- Audio and video recordings you upload
- Contact information and notes you create
- Any other original content you submit to the Services
By uploading content to the Services, you grant us a limited license to:
- Store, process, and transmit your content as necessary to provide the Services
- Use your content to generate transcriptions, analyses, and insights for your use
- Create aggregated, anonymized data for analytics and service improvement
We will not:
- Sell or license your content to third parties
- Use your content for purposes beyond providing the Services to you
- Share your content except as described in our Privacy Policy
AI-generated insights
Transcripts, personality analyses, and communication recommendations generated by the Services are licensed to you for your use. You may use these insights for your business or personal purposes.
We retain ownership of the underlying algorithms, models, and methods used to generate insights.
Feedback
If you provide feedback, suggestions, or ideas about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Services without compensation or attribution to you.
7. AI-Generated Insights Disclaimer
Important disclaimer about AI analysis
The transcriptions, personality profiles, communication recommendations, and other insights generated by ClarityCall are powered by artificial intelligence and machine learning technologies. These insights are provided for informational purposes only.
You acknowledge and agree that:
- Not professional advice: The insights generated by ClarityCall are NOT professional, legal, medical, psychological, or therapeutic advice. They should not be used as a substitute for consultation with qualified professionals.
- Accuracy not guaranteed: While we strive for accuracy, AI-generated insights may contain errors, inaccuracies, or incomplete information. Transcription accuracy depends on audio quality, accents, background noise, and other factors.
- Use at your own discretion: You are solely responsible for how you interpret and act upon AI-generated insights. We are not responsible for any decisions you make based on these insights.
- No warranty: We make no warranty that personality profiles or communication recommendations will be accurate, complete, or applicable to any specific individual or situation.
- Human judgment required: You should always exercise your own judgment and consider multiple sources of information when making important business or personal decisions.
- Not a psychological assessment: Personality profiles are communication style analyses based on conversation patterns, not clinical psychological assessments.
Limitation of use
You agree not to:
- Use ClarityCall insights as the sole basis for employment, hiring, or termination decisions
- Make medical, legal, or clinical decisions based on ClarityCall insights
- Rely on AI-generated insights for critical decisions without independent verification
- Present ClarityCall insights as professional assessments or expert opinions
8. User Data and Content
Data you provide
You are responsible for:
- The accuracy and legality of all data you upload or enter into the Services
- Maintaining backup copies of your important data
- Any consequences of sharing your data with others
We will maintain certain data you transmit to the Services for the purpose of managing performance and providing the Services. Although we perform regular backups, you are solely responsible for all data you transmit to the Services.
You agree that we shall have no liability for any loss or corruption of data, and you waive any right of action against us arising from such loss or corruption.
Data security
We implement reasonable security measures to protect your data, as described in our Privacy Policy. However, you acknowledge that no system is completely secure, and you use the Services at your own risk.

- Total storage space
- Number of contacts or analyses
- API rate limits

11. Privacy Policy
Our Privacy Policy describes how we collect, use, store, and share your personal information. By using the Services, you acknowledge that you have read and understood our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree with our Privacy Policy, you may not use the Services.
12. Term and Termination
Term
These Terms remain in full force and effect while you use the Services. Your subscription will continue until terminated by you or by us in accordance with these Terms.
Termination by you
You may terminate your account at any time by:
- Canceling your subscription through your account settings

Upon cancellation:
- Your access to paid features will continue until the end of your current billing period
- Your account and data will be retained for 30 days, after which they will be permanently deleted
- No refunds will be provided for unused time in your billing period
Termination by us
We may suspend or terminate your account immediately, without prior notice or liability, if:
- You breach any provision of these Terms
- You engage in fraudulent, illegal, or abusive behavior
- We are required to do so by law
- We discontinue the Services
Effects of termination
Upon termination:
- Your right to use the Services immediately ceases
- We may delete your account and all associated data
- You remain liable for any fees owed prior to termination
- Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, limitations of liability, and indemnification) will survive
13. Modifications and Interruptions

- WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT:
- THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SERVICES, CONTENT, OR AI-GENERATED INSIGHTS
- THE SERVICES BEING UNINTERRUPTED, SECURE, OR ERROR-FREE
- THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES
- THE QUALITY OF ANY INSIGHTS, TRANSCRIPTIONS, OR RECOMMENDATIONS
- ANY ERRORS IN THE SERVICES BEING CORRECTED
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL BITFUTURISTIC SOLUTIONS LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
- LOSS OF DATA OR INFORMATION
- LOSS OF GOODWILL OR REPUTATION
- COST OF SUBSTITUTE SERVICES
- PERSONAL INJURY OR PROPERTY DAMAGE
- ANY OTHER INTANGIBLE LOSSES
THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:
- (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR
- (B) ONE HUNDRED DOLLARS ($100.00)
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
16. Indemnification
You agree to defend, indemnify, and hold harmless Bitfuturistic Solutions LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any law, regulation, or third-party right
- Your content or recordings uploaded to the Services
- Your failure to obtain required consents for recordings
- Any claim that your content infringes or violates any third-party intellectual property or privacy rights
- Any harm caused by reliance on AI-generated insights from the Services
This indemnification obligation will survive termination of these Terms and your use of the Services.
17. Governing Law
These Terms of Service and your use of the Services are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.
Your use of the Services may also be subject to other local, state, national, or international laws. You are responsible for compliance with all applicable laws.
18. Dispute Resolution
Informal resolution
If you have a dispute with ClarityCall, you agree to first contact us at support@claritycall.app and attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith for at least thirty (30) days before pursuing formal legal action.
Governing jurisdiction
Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Washington State, and you consent to the personal jurisdiction of such courts.
Limitation on time to file claims
Any claim or cause of action arising out of or related to your use of the Services must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

There may be information in the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

Miscellaneous Provisions
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClarityCall regarding the Services.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
No agency: No joint venture, partnership, employment, or agency relationship exists between you and ClarityCall as a result of these Terms or your use of the Services.
Electronic communications: You consent to receive communications from us electronically, and you agree that all agreements, notices, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
Force majeure: We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, labor disputes, or failures of third-party services.
Export compliance: You may not use or export the Services in violation of U.S. export laws and regulations or any other applicable export control laws.
